These terms describe how we work with you at nbits. The service provider is nbits. For anything, email contact@nbits.studio. Current prices are listed on nbits.studio.
1. Services
- Website – we build a static website. The one-time price is agreed when you see the preview. The “from” price in our pricing applies to a simple website with 3–4 pages.
- “Virtual assistant” subscription (optional) – we make changes to your website under one of these plans:
- Start – 10 content changes and 1 layout change per month,
- Standard – unlimited content changes, subject to fair use (section 5), and 5 layout changes per month,
- Plus – unlimited content changes, subject to fair use (section 5), 10 layout changes and 1 hour of nbits team work per month.
- Add-on modules – features that need an integration, e.g. online booking, monitoring. They are quoted separately and delivered by the nbits team. The “Ads analytics” module (Google Analytics 4, Meta Pixel, consent banner) costs €190 / $210 one-off, and the “Google Analytics” module (Google Analytics 4 and a consent banner) €149 / $199 one-off – after it, Ads analytics costs only the difference. Both are available only for websites with an active subscription and are included in the Plus plan; nbits sets up the identifiers and configuration, and the tools’ data is processed by Google and Meta as described in the website’s privacy policy. We do not enable these modules for websites whose visits may reveal special-category data (e.g. medical practices, psychologists, law firms) – visiting such a website would pass health or personal-situation information about visitors to Google and Meta.
2. Hosting, domain and ownership
- Hosting and the SSL certificate are free of charge, with no time limit – also without a subscription.
- Free hosting covers the typical traffic of a business website. If traffic or files (e.g. videos) are unusually large, we’ll propose a solution and agree it with you before making any change.
- We provide free hosting for as long as nbits runs this service. If we ever stop, we’ll email you at least 3 months in advance, hand over your site’s files and help you move it to another host.
- Your website runs on the nbits Cloudflare account. On request, we will move it to your own account.
- You pay for your domain yourself.
- Once paid for, the website (code and content) is yours. On request, we will hand over a source package.
3. Subscription
- The first 7 days are free. After that, you pay in advance via Stripe – monthly or yearly. A yearly plan costs the same as 10 months (2 months free).
- You can cancel at any time – the subscription ends at the end of the paid period.
- Upgrades take effect immediately; downgrades take effect from the next billing period.
- After you cancel, your website keeps working. One-off changes are quoted separately.
4. What counts as a “change”
One change is one request you approve that results in one publication – no matter how many elements it updates.
Content change: copy, photos, news, categories, opening hours, service prices, team, menu, new pages built from existing sections.
Layout change: a new type of section, a new look for a section, or a rebuild of the home page, header or footer.
5. Fair use (“unlimited”)
- “Unlimited” (content changes in Standard and Plus) means roughly up to 50 publications per month. Above that, we will contact you and suggest a suitable plan or a quote.
- The subscription does not include: bulk or automated changes, a redesign of the whole website, an online store, integrations, modules, or migrating large amounts of content. These are quoted separately.
6. Content – who owns it and who is responsible
- You are the owner and publisher of the website and all its content (text, photos, prices, opening hours, news) and of the posts on your channels (Facebook, Instagram, Google Business Profile). nbits hosts the website, prepares proposed changes – including with the help of an AI assistant – and publishes them technically.
- You get a preview before anything goes live. We publish only after you approve it, and every change can be rolled back. By approving a preview or a post, you adopt its content as your own.
- Content prepared by nbits or the AI assistant is a proposal and may contain mistakes – check it before approving, especially prices, opening hours, contact details and service information.
- You are responsible for your content being accurate and lawful, in particular for: copyright and licences for text, photos and logos, consent from people shown in photos, commercial information, prices and promotions, sector rules (e.g. on advertising medical or regulated professional services) and the business details you are required to show on your website.
- As regards storing your website, nbits acts as a hosting provider (Article 14 of the Polish Act on Providing Services by Electronic Means, Article 6 of the Digital Services Act). We do not monitor content. On receiving a credible notice or an official notification that content is unlawful, we may promptly disable access to it – we will let you know. Notices can be sent to contact@nbits.studio.
- We may refuse to publish unlawful content.
- If a third party brings a claim against nbits relating to the content of your website or posts, you will indemnify nbits and cover reasonable defence costs, including any amounts awarded – we will notify you of the claim promptly (applies to business customers).
- Posts are published on your accounts on third-party services (including through publishing intermediaries) and under those services’ terms. We are not responsible for how they work, post reach, account restrictions or removed posts. Statistics and the Google Business Profile check are for information only.
7. Payments and invoices
- Prices are net; VAT or sales tax is added according to the rules of your country.
- Invoices are issued electronically.
- The website is paid for in advance, after you accept the preview (or as otherwise agreed).
- Fees for a subscription period that has already started are not refunded.
8. Availability and liability
- Websites run on Cloudflare infrastructure. We do our best to keep them available, but we do not guarantee 100% uptime.
- nbits’s liability to the customer, on any legal basis, is limited to the amount you paid us in the last 12 months. nbits is not liable for lost profits or indirect damage (e.g. lost orders, revenue, or data entered outside the panel).
- We are not responsible for content approved or provided by the customer, for third-party services (e.g. Cloudflare, Google, Meta, publishing intermediaries, the payment provider, the domain registrar) or for outages beyond our control.
- The limits in this section do not apply to damage caused intentionally or to rights that the law does not allow to be limited. They also do not limit the rights of consumers or of businesses treated as consumers.
9. Personal data
- We process the data you give nbits (e.g. when ordering and in the panel) as a controller – see our privacy policy.
- You are the controller of the data of people who use your website (e.g. who submit a form). nbits processes that data only on your behalf – for hosting the website, receiving and storing form submissions, email notifications and statistics. By accepting these terms, you entrust this processing to us (Article 28 GDPR) on the terms of this section.
- We process that data only on your documented instructions (these terms and your panel settings), ensure confidentiality of the people with access, apply appropriate security measures, help you respond to data subject requests and meet your obligations under Articles 32–36 GDPR, report personal data breaches without undue delay, make available the information needed to demonstrate compliance and allow audits by prior arrangement.
- We use sub-processors (hosting, cloud infrastructure, email). We will provide the current list on request and give 14 days’ notice of any planned change – you may object to it.
- When our cooperation ends, we will return or delete form data, at your choice, unless the law requires us to keep it.
- You are responsible for the legal basis for processing, for informing your website’s users (your business’s privacy policy) and for the data collected in your forms. Do not collect special-category data (e.g. health data) in forms unless agreed with us separately.
10. Changes to these terms
We will notify you by email at least 14 days before any change to these terms. If you don't accept the changes, you can cancel your subscription.
11. Governing law
These terms are governed by Polish law. If you are a consumer in the EU, you keep the protection of the mandatory laws of your country of residence. For customers in the United States and elsewhere, Polish law also applies, unless the law of your place of residence requires otherwise.
